These Sales Terms & Conditions apply to all purchases made through the Creates by Gem website and to all commissioned works undertaken by Creates by Gem.

By placing an order, purchasing artwork, or commissioning a piece, you agree to these terms.

1. About Creates by Gem

Creates by Gem is an independent artist business based in the United Kingdom, specialising in original artwork, reverse glass painting, and gilding.

2. Original Artwork & Prints

Creates by Gem offers both original handmade artwork and high-quality prints of selected works.

Original Artwork

Unless otherwise stated, original artworks are one-of-a-kind pieces created by hand using reverse glass painting, gilding, and other traditional decorative techniques.

Due to the handcrafted nature of the work, minor variations, textures, and imperfections may occur and form part of the character and authenticity of the piece.

Prints

Prints are reproductions of original artwork created by Creates by Gem. Unless specifically stated, prints are sold unframed and are produced using high-quality printing methods to accurately represent the original work.

Please note that colours may vary slightly between the original artwork, printed versions, and what is displayed on screen due to differences in monitors, devices, and printing processes.

Availability

Original artworks are generally unique and once sold may not be available again. Prints may be offered as open editions or limited editions, as indicated in the individual product description.

3. Orders

Orders are subject to acceptance and availability.

Once payment has been received, you will receive confirmation of your order. Creates by Gem reserves the right to refuse or cancel any order in exceptional circumstances, including pricing errors or suspected fraudulent activity.

4. Pricing

All prices are displayed in Pounds Sterling (£).

Prices may be changed at any time without notice; however, any changes will not affect orders that have already been confirmed and paid for.

Where applicable, shipping costs will be displayed at checkout before payment is completed.

5. Payment

Payment must be received in full before artwork is dispatched.

Accepted payment methods will be displayed at checkout.

For commissioned work, a non-refundable deposit may be required before work begins.

6. Commissions

Commissioned artwork is created specifically for the client and may involve consultation, design development, and bespoke production.

Commission Process

  • Initial consultation and agreement of scope

  • Quotation and deposit payment

  • Creation of artwork

  • Final payment prior to dispatch

Changes and Amendments

Reasonable amendments may be discussed during the design stage. Significant changes requested after work has commenced may incur additional charges.

Cancellation of Commissions

If a commission is cancelled after work has begun, any deposit paid will be retained to cover time, materials, and work already completed.

7. Shipping & Delivery

Artwork will be carefully packaged to ensure safe delivery.

Estimated delivery times are provided as guidance only and cannot be guaranteed.

Creates by Gem is not responsible for delays caused by postal services, couriers, customs procedures, or events beyond reasonable control.

Any customs duties, taxes, or import charges for international orders are the responsibility of the purchaser.

8. Damaged Deliveries

If artwork arrives damaged, please contact Creates by Gem within 48 hours of delivery.

Photographs of the damage, packaging, and artwork may be requested to assist with any claim against the courier.

9. Returns & Refunds

Original Artwork

If you are purchasing as a consumer within the UK, you may have certain rights under consumer protection legislation.

If you change your mind about a purchase, please contact Creates by Gem within 14 days of receiving the artwork.

Returned items must:

  • Be in their original condition

  • Be securely packaged

  • Be returned at the purchaser's expense unless faulty

Refunds will be issued after the artwork has been safely received and inspected.

Commissioned Artwork

Commissioned and personalised artworks are created specifically for the client and are therefore non-refundable and non-returnable except where the artwork is damaged upon arrival.

10. Ownership & Copyright

Ownership of the physical artwork transfers to the purchaser upon full payment.

Copyright and intellectual property rights remain with Creates by Gem unless otherwise agreed in writing.

Purchasers may not:

  • Reproduce artwork

  • Create copies or derivatives

  • Use artwork for commercial purposes

  • Manufacture products featuring the artwork

without prior written permission.

11. Website Images

Images displayed on the website are intended to represent the artwork as accurately as possible. Due to screen variations and photography, slight differences in colour and appearance may occur.

12. Limitation of Liability

To the fullest extent permitted by law, Creates by Gem shall not be liable for any indirect, incidental, or consequential losses arising from the purchase or use of artwork.

Nothing in these terms limits any rights available to consumers under applicable UK law.
